Judge grants motion to allow additional plaintiffs in EPSDT case
Judge McCann King, of the United States District Court for the Southern District of Ohio Eastern Division issued an order to allow additional plaintiffs in G.D. v. Lumpkin. The Judge's order adds three additional plaintiffs who are receiving Medicaid services through Ohio's Managed Care plans and were required to go through the prior authorization process to receive services under the Early Periodic Screening Diagnosis and Treatment (EPSDT) program.

The Judge's order adds three additional plaintiffs who are receiving Medicaid services through Ohio's Managed Care plans and were required to go through the prior authorization process to receive services under the Early Periodic Screening Diagnosis and Treatment (EPSDT) program.
G.D. v. Lumpkin is a class action lawsuit against the Ohio Department of Job and Family Services that seeks to require the state to comply with federal laws related to the EPSDT program, known in Ohio as Healthchek. The lawsuit is filed on behalf of plaintiffs and a state-wide class defined as "[a]ll children up to the age of 21 who are Medicaid eligible and have been denied access to necessary services that should have been provided through Ohio's EPSDT program."
OLRS and Advocates for Basic Legal Equality (ABLE) jointly filed a proposed motion to intervene on July 15, 2009. ABLE is a non-profit regional law firm that provides civil legal assistance to low-income clients in 32 counties in Western Ohio.
